MO user assumes all risks and waives any claims against iAwake TechnologiesLLC, its affiliates, for any and all mental and physical injuries. If other people have access to MO, the user agrees that they will be held responsible.
In no instance will iAwake TechnologiesIntegral Recovery and other MO distributors are not responsible for any chance, indirect, special, direct or indirect damages caused by the program’s instructions, documentation, or misuse.
All disputes arising from this agreement shall be resolved by the parties in a spirit and cooperation, without formal proceedings. Any dispute not resolved by the parties (except for a request injunctive relief), shall be subject to arbitration upon written demand from either party. Arbitration must take place within forty days.-Within five days after the receipt of the written request, in
Provo, Utah (or at another location if both parties agree). The arbitrator shall be chosen by the parties. Each representative will choose an arbitrator, while the representatives choose one. The arbitrator shall conduct an informal hearing, hear the arguments, then resolve the matter. Each party will pay half the cost of the arbitration proceeding. The arbitrator will not be able to award punitive damages, or any other relief not provided for in this Agreement. Each issue that is submitted to arbitration shall have a written explanation of its basis. If the award is deemed final, judgment upon it.
Any decision rendered by arbitrators may be entered in any court with jurisdiction.
