Buying and selling real estate off market requires a bunch of written agreements. The docs included contain terms that we find extremely useful in our very own real estate contracts!
We’ve included the following sample contracts as learning tools for you:
1. The simple purchase agreement: The one pager can come in handy for smaller off market deals with less instutional sellers, and can be ideal for a wholesale deal. A shorter agreement can mean less questions and complication, while including key terms that protect you as the Buyer.
2. The assignment agreement:Â Got a wholesale deal under contract? You’ll need to draft up an assignment of contract to wholesale the property to an end buyer.
3. Estoppel Letters:Â Buying a tenant occupied property? You better make sure your future tenants certify the accuracy of the existing lease terms prior to closing, or else they may try and pull a fast one on you after you take over.
4. The long form purchase agreement:Â Having a detailed purchase and sale agreement can be important when working a more professional transaction with experienced sellers and their attorneys. An agreement that outlines a variety of terms is often necessary in this case. This can also be useful when selling your property directly to a Buyer.
5. Amendment to purchase agreement:Â Simply put… things change alllllll the time in a real estate transaction.
6. Mutual Release:Â Some deals get cancelled. You need written release from contract that defines who gets to keep any deposits.
